I. Terms of Use for the WorkStyle Patterns® (WSP™) Inventories and Reports
Terms
Except to the extent governed by a separate written agreement with The McFletcher Corporation, this agreement (“Agreement”) provides the terms and conditions to access and use of the WorkStyle Alignment and WorkStyle Patterns® (WSP™) software, services and content (collectively, the “Software”) provided by The McFletcher Corporation through this site (“Site”). All copies of the Software made accessible through the Site are licensed, not sold.
By using this website, you (Customer) signify your assent to this User Agreement. If you do not agree with the terms, please do not use this site. We reserve the right at our discretion, to change, modify, add or remove portions of these terms at any time. Please check these terms periodically for changes. When the Terms of Use changes, we will also revise the “Last Updated” date at the bottom of this policy. Your continued use of this website following the posting of the changes to these terms will mean you accept those changes.

This website and any McFletcher Corporation or WorkStyle Patterns® (WSP™) publications and materials that may be accessed from it are protected by copyright, trademark, trade secret and other proprietary notes. Nothing on this website or in the McFletcher publications and material may be downloaded, reproduced, stored in a retrieval system, modified, made available on a network, used to create derivative works or transmitted in any form or by any means, electronic, mechanical, photocopying, recording, scanning or otherwise, except as expressly authorized on this website. All copyright, trademark, trade secret and other proprietary notices must be retained on the reports you may print after the completion of a WorkStyle Patterns® (WSP™) Inventory.
General Privacy and Confidentiality Information
You agree that you will keep your personal username and password confidential. Also, that you will not allow any other person to use your personal username and password to access the Software. You agree to immediately notify The McFletcher Corporation, through the WorkStyle Alignment website, www.workstylealignment.com, of any suspected disclosure of your personal password to an unauthorized person.
To further clarify copyright protection, this Website and the WSP™ Inventory Software and its databases and compilations of aggregated data, all copies thereof and associated trademarks are protected under United States Copyright law, international treaty, trade secret, trademark and other applicable laws.
Except as permitted by features of the Website and/or WSP™ Inventory Software for printing and downloading limited copies of your Software for personal, internal use and reference, you agree not to copy, reproduce, publicly display, publicly distribute, transmit of otherwise transfer the content of the Site and/or Software without the prior express written consent of The McFletcher Corporation.

Disclaimers Regarding Services and Materials
The McFletcher Corporation does not warrant or make representations regarding feedback reports or the results of the use of the reports created by the WorkStyle Patterns® (WSP™) Inventories for any reason. The WorkStyle Patterns® (WSP™) Inventories are a development resource, and the information generated by the WorkStyle Patterns® (WSP™) Inventories is not intended and should not be used as a primary resource to make decisions to hire, fire, promote, demote or otherwise determine the status of current or future employment by any user or Customer.
McFletcher functionality will not be responsible for problems or delays in accessing any of the materials or services offered on any of the WorkStyle Patterns® (WSP™) Inventories for any reason beyond McFletcher’s actual control including reasons related to Customer’s own hardware, software or connectivity. Further, McFletcher does not guarantee that functions and materials contained in any WorkStyle Patterns® (WSP™) Inventory will always be uninterrupted or error-free and that defects will be immediately corrected. McFletcher will, however, attempt to address customer concerns in reasonable means and a timely manner. McFletcher does not guarantee that any WorkStyle Patterns® (WSP™) Inventory, or the server that makes them available, will be and remain free of viruses or other harmful components.
Limitation of Liability
All materials in this site are provided “AS IS.” To the fullest extent permissible pursuant to applicable law, The McFletcher disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. In no event shall The McFletcher Corporation, a WSP™ Certified Facilitator, a WSP™ Licensed Coach, Sponsor or Qualified Administrator or anyone else involved in providing the WorkStyle Patterns® (WSP™) Inventories and its written or printed material, even if advised of the possibility of damages, be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of the use or inability to use the WorkStyle Patterns® (WSP™) Products.
Infringer Policy
For both your and our protection, The McFletcher Corporation, in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, it is the policy of The McFletcher Corporation to terminate (at it’s sole discretion and without prior notice) users or members who are deemed or suspected by The McFletcher Corporation to be repeat infringers. The McFletcher Corporation may also at its sole discretion limit access to the site and/or terminate access and use by any user or member who infringes any intellectual property of others, whether or not there is any repeat infringement.

The McFletcher Corporation is committed to protecting the privacy of your personal information. We have policies and procedures to protect the confidentiality of your personal information and to control access to it. This privacy policy applies to WorkStyle Patterns® (WSP™) Inventory and the WorkStyle Alignment website owned and operated by The McFletcher Corporation. Password Security
It is vital that you agree to treat the username and password as confidential information and NOT share them with anyone. This is important for you, as you do not have to complete the WorkStyle Patterns® (WSP™) Inventories in one session. Your Inventory results will be available for reentry. Keep your access code, username and password available for reuse. Should you misplace your Access Code, username or password, you have the right to access the personally identifiable information that you have provided to review and use. You may make a request through sending an email to wsp@workstylealignment.com. The email request should be followed with written proof of identity.
Personal Information Protection
The WorkStyle Patterns® (WSP™) Inventories require you to provide personally identifying information to obtain access to the WorkStyle assessments and subsequent reports. McFletcher Corporation recognizes the importance of protecting the information collected in the operation of the WorkStyle Patterns® (WSP™) Inventories and will take reasonable steps to maintain the security, integrity and privacy of this information. However, no transmission of data over the Internet or any public network can be guaranteed to be 100% secure. Although we make reasonable efforts to safeguard your personal information once we receive it, we cannot warrant the security of information you transmit to us.
We will not disclose your personally identifying information to any third party. We do not barter, trade or sell access to your personally identifying information. We use cookies to store user information. Certain country, United States’ federal, state, local or other government regulations may require that we disclose personally identify information about you in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. In such cases, we will use commercially reasonable efforts to disclose only the information required under applicable law.
Demographic Information
Demographic information is collected at the point of registration and with those portions of the WorkStyle Patterns® (WSP™) Inventories that make use of demographic information as part of its function. This information also aids The McFletcher Corporation in its ongoing research efforts and is used for improvement of Inventories.
Inventory Results
Your responses to the WorkStyle Patterns® (WSP™) Inventory Assessments and related reports will not be transferred or shared to a third party without your written permission. If you have an agreement with a software licensed WSP™ coach, Qualified WSP™ Administrator, Certified WSP™ Facilitator, Organization Sponsor or McFletcher Consultant, your information will be shared with them as per your working agreement. For research purposes, we may aggregate your responses to our WorkStyle Patterns® (WSP™) Inventory Assessments with the responses of other individuals to develop group norms, conduct validation studies, perform statistical analysis, and develop new products and other similar activities to improve our Inventories for future use. However, such data will only be used in the aggregate and will never disclose any individual’s identity.
General Privacy Information

We have no control over the privacy practices of such other websites nor should any such link be considered an endorsement of such other web site’s privacy policy.
